On the 13th April 2016 the Minister for Jobs, Enterprise and Innovation, Mr. Gerald Nash, issued S.I. 165 of 2016 cited as “The Construction Contracts Act 2013 (Appointment Day) Order 2016” giving an Effective Date of the 25th July 2016 to the Construction Contracts Act 2013 [Full a copy of the SI please click here] .

It is clear that the Act will apply to all Construction Contracts [Refer to S1(1) of the 2013 ACT] entered into after the Effective Date, for the avoidance of doubt this will relate to any Construction Contracts placed post the Effective Commencement Date, whether they relate to a Main Construction Contract which was entered into prior to the Effective Commencement Date.

It is important to note that the order, via SI 476 of 2014, SI 173 of 2015 and SI 426 of 2015, confirms the empowerment of Gerald Nash as the Minister of State at the Department of Jobs, Enterprise and Innovation to issue SI 165 of 2016 [The definition of “Minister” under the 2013 Act refers to the Minister for Public Expenditure and Reform]. Any reference to the “Minister” under the 2013 Act is now to the Minister for Jobs, Enterprise and Innovation.
